These General Terms and Conditions regulate the Purchase Agreement between Sotora Internacional S.A., Apdo. 820-1250, Escazú, Costa Rica, Cedula no. 3-101-508915 (hereinafter referred to as Costa Rica Spirits Shop) and the Buyer (hereinafter referred to as Buyer).

Costa Rica Spirits Shop is hereby selling and Buyer is hereby purchasing products and services online through the shop of Costa Rica Spirits, www.costarica-spirits.com/shop, at the terms and conditions hereinafter set forth:

Buyer & Recipient

The Buyer may be equal or different to the Recipient of the purchased product. If the Buyer is different from the Recipient, the purchased product is interpreted as a gift from the Buyer to the Recipient and it shall be internationally shipped as such.

The Buyer or the Recipient may be either an individual or a business entity.

If the Recipient of a Rocking Chair is an individual who is resident in any country of the European Union, except of Switzerland, the Buyer shall be:

-         a business entity (also "Freiberufler" are accepted), resident or non-resident in any country of the European Union, or

-         an individual, non-resident in any country of the European Union.

Purchase Agreement

By the purchase of a product or a service, the Buyer is submitting a binding offer, to which he is bound. If the Buyer receives the “confirmation of receipt of order” by email, the agreement is definitely concluded.

Payment

The Buyer may choose between the paymente methods “invoice” or online-payment by credit card or online-payment by paypal. If the Buyer chooses "invoice", he receives 5% discount. The purchased products shall not be shipped respectively the service shall not be provided before receipt of the payment.

The online-payment by credit cards will be processed by 2Checkout.com Inc. (Ohio, USA). 2Checkout is an authorized retailer of goods and Services of Costa Rica Spirits Shop.

Costa Rica Spirits Shop commissioned 2Checkout.com to provide online-payment services. When the Buyer clicks on the link to pay, 2Chekcout.com handles the sale in a secure environment. 2Checkout charges Costa Rica Spirits Shop a commission for this service.

Return Policy

Heavily defective, heavily damaged or incorrect products may be returned. A product is heavily defective or heavily damaged, if the intended use is limited. In all other cases products may be returned only if the Buyer's country law stipulates the right to return.

The products must be returned unused, clean, and undamaged in case of incorrect products, and complete with all manuals, accessories, documents and in the original and undamaged packaging to qualifiy for refund. The items must be in a resalable condition free of any non-removable labels or writing on the product or product packing. Books and CD's must be returned unopened to be considered 'unused'.

Costa Rica Spirits Shop shall provide a full refund in case of incorrect products. In all other cases Costa Rica Spirits Shop shall not refund the shipping charges paid by the Buyer unless the Buyer's country law so stipulates.  

The Buyer shall notify by email to shop@costarica-spirits.com the receipt of a product which qualifies for return within 2 days of receipt of the product, unless the Buyer's country law stipulates a longer time limit. Costa Rica Spirits Shop confirms the receipt of the Buyer's notification by email. Returns should be sent within 3 working days after receipt of Costa Rica Spirits Shop's confirmation of receipt of Buyer's notification, and if in particular case not otherwise indicated by Costa Rica Spirits Shop in its confirmation, to the following address:

A copy of the original invoice must accompany the return of the product.

Failure to comply with this return procedure and with the instructions in Costa Rica Spirits Shop's confirmation of receipt of Buyer's notification will result in an unprocessed return.

Costa Rica Spirits reserves the right to reject refunds if the Buyer does not comply with the Return Policy rules. Costa Rica Spirits Shop shall not send a product back to the Customer if it is not eligible for a refund.

Any refund will be made within 30 days of the processed return.

Impuestos de Venta (I.V.)

If Cost Rica is the shipping destination, the 13 % "impuestos de ventas" will be added to the product price.   

Shipping Costs & Delivery Time

The costs of shipping are borne by the Buyer through a surcharge added to the product price.

Delivery time to San José is between 3-10 days; Delivery inside of Costa Rica is between 5-15 days; Delivery inside San José ist between 3-10 days.

Costa Rica Spirits Shop accepts orders from outside Costa Rica. Shipping rates and fees may vary depending on the delivery address.

The costs of shipping are borne by the Buyer through a surcharge added to the product price.

Import, Customs, Duties and Taxes

The Recipient is responsible for assuring that the product can be lawfully imported to the destination country. When ordering from Costa Rica Spirits Shop, the Recipient is the importer and must comply with all laws and regulations of the destination country. Orders that are shipped to countries outside of Costa Rica may be subject to import taxes, customs duties and fees levied by the destination country. The Recipient of an international shipment may be subject to such import taxes, customs duties and fees, which are levied once a shipment reaches the destination country. Additional charges for customs clearance must be borne by the Recipient; we have no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country; you should contact your local customs office for further information.

Delivery Time

Delivery time outside of Costa Rica is between 10-20 days.

When orders shipped internationally reach the destination country, they may be subject to customs clearance procedures which can cause delays beyond original delivery estimates.

Privacy Policy

Personal information is not collected if the Buyer simply browses through the products and services in Costa Rica Spirits Shop. Costa Rica Spirits Shop only collects personal information during the Buyer’s visit to the Online Shop if the Buyer chooses to purchase a product or uses the Contact page. Costa Rica Spirits Shop neither sells nor licenses any personal information collected from the Buyer or the Recipient of the goods in Costa Rica Spirits Shop to external companies

International Recipient should be aware that cross-border shipments are subject to opening and inspection by customs authorities. The charges for opening are always the Recipient’s responsibility.

Also, Costa Rica Spirits Shop may provide certain order, shipment, and product information, such as titles, to international carriers, and such information may be communicated by the carriers to Recipient's authorities in order to facilitate customs clearance and comply with local laws.

Changes of these General Terms and Conditions

These General Terms and Conditions are subject to change without prior notice. The terms that are valid at the time of each booking shall apply. The user has no claim that future bookings be completed under existing conditions.

Intended Use & Limitations of Liability

All users are open to visit the website of Costa Rica Spirits Shop according to its intended use.

Costa Rica Spirits Shop does not accept liability for damages caused by computer viruses, spyware and other malicious computer programs.
